Privacy Policy

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE WEBSITE. BY ACCESSING AND/OR USING THE WEBSITE (OTHER THAN TO READ THIS PRIVACY POLICY FOR THE FIRST TIME), YOU ARE AGREEING TO COMPLY WITH THIS PRIVACY POLICY HEREIN.

1) Scope

This Policy contains how we collect, use, disclose, and protect information when you visit czoptimization.com, use our applications and tools (including the LifeReckoner™ application), book services, purchase plans, subscribe, or communicate with us (collectively, the "Services").

2) Important note about our services (not medical care)

CZ Optimization provides educational and informational content, tools, and coaching. We are not a medical provider, and we do not provide medical advice or create a doctor-patient relationship. (See Terms & Conditions for additional disclaimers.)

3) Information we collect

A. Information you provide — Account / booking details (name, email, phone, billing address, booking details, communications); Payment information (status and transaction details; card details are processed by our payment processor and not stored by us in full); Information you provide to our coaching and to our tools (goals, lifestyle, and other information you choose to share, which may include wellness, fitness, or other health-related information). Health-related values you enter into the LifeReckoner™ application are used to generate your scenario and are not retained by us after your session.

B. Information collected automatically — Device and usage data (IP address, device identifiers, browser type, pages viewed, clicks, referring pages, approximate location from IP); Cookies and similar technologies for functionality, security, analytics, and preferences.

C. Information from third parties — Platform providers (Vercel, Supabase); payment processors (e.g., Stripe); analytics/communications tools if enabled (Kit, Resend); video/messaging tools if used (Mux).

4) How we use information

  • Provide and administer the Services (booking, scheduling, account access, messaging).
  • Process payments and prevent fraud.
  • Communicate with you (service updates, confirmations, support).
  • Personalize and improve the Services and user experience.
  • Comply with legal obligations and enforce our Terms.

5) How we share information

We may share information with service providers (hosting, booking, payments, analytics, communications); with contractors/assistants under confidentiality expectations; for legal and safety reasons; and in a business transfer, subject to applicable law. We do not sell your personal information for money as a general practice. If our practices change, we will update this policy and provide required choices.

6) Cookies and tracking

We (and service providers like Vercel) may use cookies and similar technologies for functionality, security, basic analytics, and preferences. You can control cookies through your browser settings; disabling cookies may limit site functionality. We do not sell your information to third parties.

7) Data retention and security

We retain data in compliance with the laws of State of Nevada, specifically those outlined in NRS 603A, as well as any requirements outlined within the Payment Card Industry Data Security Standard. Personally identifiable information will be stored as long as it is necessary to comply with the terms of this Privacy Policy and the Terms & Conditions of our website. Any information related to payment processing is handled by third parties.

We have implemented security measures we consider reasonable and appropriate to protect against the loss, misuse and alteration of the information under our control. Please be advised, however, that while we strive to protect your personally identifiable information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your personally identifiable information.

In the unfortunate event that your "personally identifiable information" (as the term or similar terms are defined by any applicable law requiring notice upon a security breach) is compromised, we may notify you by e-mail (at our sole and absolute discretion) to the last e-mail address you have provided us in the most expedient time reasonable under the circumstances; provided, however, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation. We will comply with all state laws related to the disclosure of data breaches, if applicable. From time to time we evaluate new technology for protecting information, and when appropriate, we upgrade our information security systems.

8) Your choices

Marketing emails: opt out using the unsubscribe link or by emailing us. Access/corrections: request access to or correction of certain information by contacting us. Deletion: request deletion of certain information, subject to legal/operational exceptions (e.g., payment records).

9) State-Specific Privacy Rights

Nevada law provides Nevada consumers certain rights related to the "sale" of covered information and requires a way to submit a verified request to opt out of such "sales." Designated request address: info@czoptimization.com, subject line "Nevada Privacy Opt-Out Request." Include your name, Nevada residency statement, email, and enough information to reasonably verify your request. We will respond within the timeframe required by Nevada law (generally within 60 days, with a possible extension where allowed).

Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes. You are limited to one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response.

10) Nevada Consumer Health Data Privacy Notice (NRS 603A.400–603A.550)

Because we may collect wellness and health-related information in the course of coaching or through our tools and applications (such as the LifeReckoner™ application), Nevada law may treat some information as "consumer health data" (personally identifiable info linked to health status).

A) Categories we may collect — fitness and wellness goals, routines, and progress notes; nutrition and lifestyle information you provide; self-reported symptoms, sleep/recovery information, and other health-status information you choose to share; health-related values you enter into the LifeReckoner™ application (such as biomarkers or lab values) to generate your scenario; files you upload or provide (e.g., wellness logs, lab reports).

B) How we use it — only to provide the services you request (including generating the scenarios and outputs you request from our applications), communicate with you, and maintain service records consistent with this policy.

C) Consent — Nevada law generally requires affirmative, voluntary consent to collect consumer health data unless collection is necessary to provide a requested service, and separate consent to share it (with limited exceptions). We do not share consumer health data except as needed to provide Services, with your consent, or as required/authorized by law.

D) Your rights & requests — to submit a request, email info@czoptimization.com with subject "NV Consumer Health Data Request" and include your name, email, what you’re requesting, and information to verify identity. We will respond as required by law.

11) Children’s privacy

Our Services are intended for adults. We do not knowingly collect personal information from children under 13.

12) Changes to this Privacy Policy

We reserve the right in our sole discretion and at any time and for any reason, to modify or discontinue any aspect or feature of the Website or to modify this Privacy Policy. In addition, we reserve the right to provide you with operating rules or Additional Terms that may govern your use of the Website generally, unique parts of the Website, or both (Additional Terms). Any Additional Terms that we may provide to you will be incorporated by reference into this Privacy Policy. To the extent any Additional Terms conflict with this Privacy Policy, the Additional Terms will control.

13) Sole Statement

This Privacy Policy as posted on this Website is the sole statement of our privacy policy with respect to this Website, and no summary, modification, restatement or other version thereof, or other privacy statement or policy, in any form, is valid unless we post a new or revised policy to the Website.

14) Other Sites; Links

Our Website may link to or contain links to other third party Websites that we do not control or maintain, such as in connection with purchasing products referenced on our Website and banner advertisements. We are not responsible for the privacy practices employed by any third party Website. We encourage you to note when you leave our Website and to read the privacy statements of all third party Websites before submitting any personally identifiable information.

15) Choice of Law and Venue

This Privacy Policy shall be construed in accordance with the laws of the State of Nevada without regard to its conflict of laws rules. Any action or proceeding arising out of or relating to this Privacy Policy shall be brought exclusively in the state courts located in Clark County, Nevada, or, if federal jurisdiction exists, in the United States District Court for the District of Nevada. Each party irrevocably submits to the exclusive jurisdiction of such courts and waives any objection to venue in such courts, including any objection based on inconvenient forum.
